BUYING AN EXISTING BUILDING

First of all, it is necessary to underline the difference between Luxembourg and Spain with regard to the roles of the stakeholders. If in Luxembourg, it is the notary who takes care of all the formalities, including research on the property, debts, easements, land registry, etc., this work is divided into two parts in Spain: research on the property, authorizations, debts and its occupants are made by a lawyer specializing in real estate and the signing of the deeds is done by the notary.

If you are buying an existing property in Tenerife, we ask the owner for the "compra venta" contract which clearly indicates the cadastral number. We take a copy of this deed and give it to the notary. We also ask for the latest payment receipts for water, electricity and IBI (cadastral income), as well as proof of community.

 

Then, you should request a “Nota Simple” (extract from the land register in which any debts, mortgages or charges weighing on the property appear). A notary cannot issue a deed if debts or charges appear in the “Nota Simple”. We require a certificate from the community indicating that all charges will be paid to the community until the date of the deed. Once all these documents have been collected, we can give them to the notary's clerk so that he can prepare a draft deed.
